1. About TheBidCraft

TheBidCraft ("the Service", "we", "us", "our") is a web-based software product operated at thebidcraft.com. The Service provides contractors and tradespeople with AI-assisted tools to generate professional bid proposals and estimates. TheBidCraft is an independent product and is not affiliated with any contractor licensing body, government agency, or trade association.

2. Eligibility

By using TheBidCraft you represent that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You will use the Service only for lawful business purposes
• The information you provide when creating an account is accurate and current

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activity that occurs under your account. You agree to notify us immediately at thebidcraft@gmail.com if you suspect unauthorized access to your account.

You may not share your account with other individuals, transfer your account to another person, or use someone else's account without permission.

4. AI-Generated Content — Important Disclaimer

TheBidCraft uses artificial intelligence to generate contractor bid proposals based on information you provide. You acknowledge and agree to the following:

• AI-generated proposals are starting points and estimates only. They are not guaranteed to be accurate, complete, or appropriate for your specific job, location, or circumstances.
• Pricing, labor estimates, material costs, and line items generated by the AI are based on general market data and may not reflect actual costs in your area or for your specific project.
• You are solely responsible for reviewing, verifying, and approving every proposal before sending it to any client. Sending a proposal to a client constitutes your acceptance of its contents.
• TheBidCraft does not provide legal, financial, or professional contracting advice. AI-generated content should not be relied upon as a substitute for professional judgment.
• We are not responsible for any financial loss, disputes with clients, incorrect pricing, or any other consequence arising from the use of AI-generated proposals.
• You retain full ownership of the proposals you generate. We do not claim any rights over your output.

5. Acceptable Use

You agree to use TheBidCraft only for its intended purpose — generating legitimate contractor bid proposals for real business use. You agree not to:

• Use the Service to generate fraudulent, deceptive, or misleading proposals
• Attempt to reverse-engineer, copy, or replicate the Service's underlying technology
• Use automated tools, bots, or scripts to abuse the free trial system or circumvent usage limits
• Share, resell, or sublicense your account access to third parties
• Use the Service in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to our systems, databases, or other users' accounts
• Submit false, harmful, or illegal content through the proposal generation form

We reserve the right to suspend or permanently terminate any account that violates these terms without refund.

6. Subscription and Payment

TheBidCraft offers a free trial of 5 proposals with no credit card required. Paid plans are available on a monthly subscription or one-time lifetime basis.

• Monthly subscriptions are billed on a recurring basis. You may cancel at any time. Cancellation takes effect at the end of the current billing period.
• Lifetime plans are a one-time payment granting perpetual access to the Service for as long as the Service operates.
• All payments are processed securely by Stripe. We do not store your payment details.
• Prices are displayed in USD. We reserve the right to change pricing at any time with reasonable notice to existing subscribers.
• Existing subscribers will not have their price changed mid-subscription period without notice.

7. Service Availability

We aim to keep TheBidCraft available at all times but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

For lifetime plan holders: we commit to maintaining the Service in good faith. In the unlikely event that we discontinue TheBidCraft entirely, lifetime subscribers will receive a minimum of 90 days notice and a prorated refund calculated from the date of discontinuation notice.

8. Intellectual Property

All aspects of the TheBidCraft platform — including its design, code, branding, and underlying systems — are the intellectual property of TheBidCraft and are protected by applicable copyright and trademark laws.

You retain full ownership of the proposals and content you generate using the Service. We do not claim ownership over your output. By using the Service, you grant us a limited, non-exclusive license to process your inputs through our AI systems solely for the purpose of generating your requested output.

9. Limitation of Liability

To the fullest extent permitted by applicable law, TheBidCraft and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Loss of profits or revenue resulting from use of AI-generated proposals
• Client disputes arising from proposal content
• Errors or inaccuracies in AI-generated pricing or scope of work
• Service interruptions or data loss

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to TheBidCraft in the 30 days preceding the claim.

10. Disclaimer of Warranties

TheBidCraft is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated content will be accurate, complete, or fit for any particular purpose.

11. Indemnification

You agree to indemnify and hold harmless TheBidCraft, its operators, and affiliates from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your use of AI-generated proposals in your business dealings.

12. Privacy

Your use of TheBidCraft is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of significant changes via email. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. The "Last updated" date at the top of this page reflects when changes were last made.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If resolution cannot be reached, disputes shall be subject to binding arbitration.
